The case involves an employee who suffered a knee injury on the job and returned to work on light duty. While on restricted duty, the petitioner, a Dollar General manager, left the store to make a bank deposit. After leaving employees in the store without supervision, the man was promptly fired. After his termination, the employee filed for unemployment benefits but was denied based on the fact that he was fired for wrongdoing.
The petitioner then filed a motion for medical and disability benefits with the Division of Workers' Compensation based upon his doctor's opinion that he was unable to work pending knee surgery. He was then granted three months of temporary benefits. At the end of those three months, the man applied for an extension of benefits.
In that motion, he mentioned that his termination was due to his injury preventing him from work - not because of his misconduct on the job. The Judge of Compensation determined that the petitioner had not been completely truthful in stating the cause of his termination, a decision which the man appealed.
Eventually reaching the Appellate Division, the man was denied additional benefits based upon the fact that he was not credible in claiming his termination was due to a work-related injury. Additionally, it was established that the man had not declined any work prospects because of the knee injury suffered at work. His lack of employment was a direct result of a violation of company policy - not because of any issue related to his injury.
